President Obama 2011 Budget Proposal Affecting Independent Contractor Status

In his 2011 budget, President Obama proposed to "increase certainty with respect to worker classification" by a modification of Section 530 of the Revenue Act of 1978. Under his proposal, the IRS would be permitted to require prospective reclassification of workers who are currently misclassified and whose reclassification has been prohibited under current law. Specifically, the misclassification under review concerns independent contractor status versus employees. Under this proposal the treasury and the IRS would make guidance clearer and would generally be industry-or-job-specific. If passed this proposed change would become effective in FY2011.
